The personal data that you provide us and those that you provide us at any time will be included in an automated file for which SIMORRA TIENDAS SA is responsible, for the following purposes:

a.Manage your registration as a user on our Platform.

b. Develop, comply with and execute the sales contract entered into when acquiring products from JAVIER SIMORRA.

c. Inform, process, manage and send your order (and any return) as well as the completion of the sales contract for the products you have acquired.

d.Contact you via email, phone calls, SMS or other equivalent electronic means of communication, in relation to updates or informative communications related to the functionalities, products or contracted services, including security updates of the Platform, whenever necessary or reasonable for its execution.

e.To respond to and follow up on queries and requests that you send us through our Customer Service or in our stores.

f. Provide you with information about the products marketed by SIMORRA TIENDAS SA, as well as any other complementary products, including, in relation to said products, the sending of future commercial and advertising offers through any available communication channel, including SMS messages to mobile phones, email, etc.

g.Create user profiles.

h.Conduct market studies and statistics on our products.

At JAVIER SIMORRA we are committed to treating your personal data with complete confidentiality and to applying appropriate physical, technical and organisational security measures to protect it.

The personal data provided will be kept for as long as the business relationship or the one that originated the processing is maintained. If you decide to cancel your personal data, it may be kept in our databases for the periods provided for by law in order to comply with tax and accounting obligations, and will be deleted once said legal periods or those that are applicable have expired.

3. NEWSLETTER SUBSCRIPTION

In the event that you authorize your subscription to the Newsletter or to become a member of Javier Simorra's SIMORRA CLUB, we will provide you with information about our products and services through various means such as, among others, email, any other equivalent means of electronic communication, such as SMS. Subscription to the Newsletter or membership of Javier Simorra's SIMORRA CLUB may entail the use of your Personal Data to make personalized advertising available to you, related to our products and services through emails, SMS, or other electronic means of our own or through third-party collaborators. In order to improve the service we provide you, we inform you that the Personal Data related to your purchases in our online and physical stores, tastes and preferences may be used for analysis purposes, generation of usage profiles, marketing studies, quality surveys and improvement of interaction with our customers. Likewise, you may unsubscribe through the link enabled for this purpose in each of our newsletters and following the instructions provided.

4. LEGITIMATION FOR THE PROCESSING OF YOUR DATA

The legal basis for the processing of your data as a customer is found either in the contractual relationship established when you have purchased products from JAVIER SIMORRA, or in the express consent that is requested and given when you subscribe to the Newsletter or when you become a member of the SIMORRA CLUB, as well as in compliance with commercial, fiscal and accounting obligations.

The communication of offers and promotions, the sending of advertising by any means of communication, as well as the creation of profiles and the transfer of your personal data to third parties, are also based either on the contractual relationship established by having acquired products from JAVIER SIMORRA, or on the express consent that is requested and given by you when subscribing to the Newsletter or when becoming a member of CLUB SIMORRA.

5. THIRD PARTIES TO WHOM YOUR DATA IS COMMUNICATED

In order to offer you a quality service, SIMORRA TIENDAS SA is obliged to provide certain data of its users to other companies that collaborate in the provision of the service (transporters, financial institutions, franchisees, etc.). In all cases, the data provided is strictly necessary for the specific activity to be carried out. By accepting this Privacy Policy, you expressly authorize SIMORRA TIENDAS, SA to transfer the personal data you provide to us to other companies in the group or third-party collaborators of SIMORRA TIENDAS SA, whether within or outside Spanish territory, and offering a level of protection comparable to that established in Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 (GDPR), in Organic Law 15/99 of December 13 on the Protection of Personal Data (LOPD), and in other regulations in force on the matter.

6. YOUR RIGHTS IN RELATION TO THE DATA PROVIDED

Any person has the right to obtain confirmation as to whether or not our organisation is processing personal data concerning them. You may, at any time, exercise your right to access, rectify, cancel and oppose the processing of your data under the terms established in the LOPD and related regulations. If you decide to exercise such rights, you must state in said communication the data for which you are interested in accessing, correcting, cancelling or opposing. 7. ORGANIC LAW ON DATA PROTECTION

The personal data that you provide us and those that you provide us at any time will be included in an automated file for which JAVIER SIMORRA, SA is responsible, for the purpose of maintaining and developing our relations and informing you of future commercial and advertising offers through any available communication channel, and may be transferred to other companies in the group or third-party collaborators of JAVIER SIMORRA, SA, whether within or outside Spanish territory, and offering a level of protection comparable to that established in Organic Law 15/99 of 13 December on the Protection of Personal Data (LOPD).

Unless otherwise communicated in writing within 30 calendar days from the sending or delivery of this document, we understand that you expressly and unequivocally consent to the transfer of your personal data. You may, at any time, exercise your right of access, rectification, cancellation and opposition to the processing of your data under the terms established in the LOPD and concordant regulations, by post to Carrer Córsega 222, Bajos, 08036, Barcelona.

The data provided by the user through the website, email and/or telephone may be used to send advertising by any means, including SMS messages to mobile phones, email, etc. In the case of the telephone sales service, when you click on "Request a call" you will give your consent for us to contact you, helping you to make your online purchase by telephone.
